Frequently Asked Questions: Eminent Domain

Eminent domain law is complicated, and the questions you may have will likely go unanswered unless you speak directly with a lawyer. At Lavery Law, we work with both individual and commercial property owners throughout Pennsylvania. We offer comprehensive representation, honest advice and strong advocacy.

Eminent Domain FAQ

Our attorneys often get questions regarding the eminent domain process/procedures, compensation packages and more. Below is a list of some of the most frequently asked questions about condemnation.

1) How much compensation am I entitled to? Compensation packages are important, and when you work with our team, we will carefully review all aspects of your agreement. Our goal is to make sure that you receive fair compensation for the property taken by measuring damages and identifying the full diminished value of the property. However, the amount of compensation will vary based on the property and the size, nature and scope of the taking.

2) Can the condemning authority actually take my property? In most cases, if the condemning authority is a government utility, public utility or other authorized entity that has followed the proper procedures, condemnation can occur.  But this can be a case-by-case situation. If you are involved in one of these projects, we can review your situation.

3) Do I need to work with a lawyer? The condemnation process is extremely complicated, and only lawyers who routinely work in this area of law fully understand the process. The cases we handle at Lavery Law are usually accepted on a contingency fee basis. This means you are not responsible for lawyer fees unless we win a financial recovery in your case. If you have questions about fees, we invite you to contact our firm.
